In the federal system, there are three types of employment contracts: enterprise agreements must meet the “best overall test” (BOOT) in relation to the premium. In reality, this means that the worker must turn better financially if he is at the end of the contract than he would have been under the premium. An employment contract will come into effect on the day of the submission (s347 (1)). It ceases to enter into force if it is lifted in accordance with Part 8, Section 9 of the Act, if it is replaced by another AWA or if the Court of Justice has quashed it (S347(4)). Where a labour agreement contains terms of an industrial instrument in accordance with s355 (use by reference to terms from an industrial instrument), the worker does not have access to the agreement unless he has access to the industrial instrument (s337 (6)). [1] Mining companies have encouraged the agreements with some success and have offered substantial wage increases to workers who have opted for an AWA. When an employer intends to have a labour agreement approved, it must take all reasonable steps to give a copy of the agreement to all eligible workers or grant them access to the agreement at least 7 days before the agreement is approved (s337 (1)). In addition, the employer must take all appropriate measures to provide a statement of information to eligible workers at least 7 days before the contract is approved (s337 (2)). The Fair Labour Commission can provide information on the process of drafting enterprise agreements, evaluate and approve agreements. We can also deal with disputes over the terms of the agreements. In addition, there are generally binding collective agreements.

These important agreements also bind disorganized employers and workers who work for them. Federal enterprise agreement laws were amended on January 1, 2010. In April 2007, the Sydney Morning Herald reported that it had received unpublished government tables showing that 27.8% of the agreements had eliminated the conditions that were to be protected by law. [12] [13] The tables were based on a sample of AWA agreements. [14] Agreements are generally specific to the field. They include the conditions of employment of working office workers, for example. B, in the finance, IT services, construction, metallurgical and data communication sectors. In the federal public service, the Department of Employment and Labour Relations reported that as of December 31, 2004, out of 124,500 permanent public and parliamentary employees, 11,085 AWAs (for 1928 Senior Executive Service (SES), for which AWAs are mandatory, and 9,157 other employees.

[5] The remaining permanent staff were covered by 101 certified agreements as of 30 March 2005, including 70 trade union enterprise agreements and 31 non-union enterprise agreements. [6] Enterprise agreements must have an expiry date of no more than four years from the date the Agreement was approved by the Fair Work Commission. The collective agreement covers you against arbitrary dismissals and dismissals, because the agreements set out the rules to be followed in the event of termination, i.e. the so-called termination procedures.
