Company agreements are collective agreements concluded at company level between employers and employees on working and employment conditions. The Fair Work Commission can provide information on the process of establishing company agreements and evaluate and approve agreements. We can also look at disputes that arise over the terms of the agreements. Under the national labour relations system, there are two categories of agreements: under Australian labour law, the 2005-2006 industrial reform, known as “WorkChoices”[3] (with the corresponding amendments to the Workplace Relations Act (1996), changed the name of these contractual documents to “Collective Agreement”. National labour legislation may also impose collective agreements, but the adoption of the workchoices reform will reduce the likelihood that such agreements will be concluded. A representative is a person or organization that can designate any party to the company agreement to represent it during the negotiation process. The decision of the High Court of Australia in the Electrolux case against The Australian Workers` Union has highlighted an important legal issue regarding company agreements.
